Law 231/01 and Whistleblowing

Our Organisation promotes a corporate culture characterised by honesty, respect for legality, loyalty, fairness in human relations, the ability to work in harmony, justice, transparency and by an appropriate system of corporate governance.

This includes giving appropriate importance to reports on potential breaches of regulations.

As such, potential breaches of the law should always be reported, as provided for in the ‘Whistleblowing Policy/Procedure’ adopted by our Organisation.

The “Whistleblowing Policy/Procedure” complies with the requirements set forth by Legislative Decree No. 24 of 10 March 2023 (implementing the European Whistleblowing Directive 2019/1937), by the Organisation, Management and Control Model pursuant to Legislative Decree No. 231 of 2001.

Persons who can send reports, and who may benefit from the protection provided for by the legislation, include everyone belonging to the following categories: employees; self-employed workers; workers or co-workers supplying goods or services or carrying out works for third parties (employees or co-workers of suppliers); freelancers and consultants; volunteers and trainees; shareholders and persons with administrative, management, control, representation functions for the Organisation.

Reports may be sent, at the discretion of whistleblowers, in the following ways:

The confidentiality of persons and reported facts is guaranteed in all cases. Whistleblowing channels may not be used by third parties to bring complaints relating to business relations, nor should they be used to report personal grievances or claims/complaints that are bound by the rules of employment relationships or which concern relations with one’s superior or colleagues, unless these are connected to or associated with a breach of the rules laid down in the Whistleblowing legislation.
